Terms of Use

These terms ("Terms") govern your use of the website at blinkenlight.co.uk and its sub-pages (the "Site"), operated by BLINKENLIGHT Ltd ("we", "us"). By using the Site you accept them; if you do not agree, please do not use the Site. The Site is intended for business users, not consumers.

Engagements are governed by a separate contract

These Terms cover use of the Site only. They do not create or evidence any engagement. All consultancy, design and engineering work is governed exclusively by our separate written Terms and Conditions of Business (Design Services) agreed for that engagement, which is the entire agreement for it and prevails over anything on the Site if there is any conflict. Nothing here overrides or summarises that contract, and no engagement arises merely from using the Site or sending an enquiry or booking request.

Acceptable use

You may use the Site only for lawful purposes — to learn about our services and contact us. You must not misuse it: no unlawful, fraudulent or infringing use; no spam; no malware or attempts to gain unauthorised access to, or disrupt, the Site; and no scraping, copying or commercial exploitation of the Site except as we expressly permit. We may suspend access for breach and report unlawful activity to the authorities.

Intellectual property

We (or our licensors) own all intellectual property in the Site and its content. You may view and take copies of extracts for your own internal, non-commercial use in evaluating our services, keeping any notices intact; otherwise the Site may not be reproduced or used commercially without our written consent. The BLINKENLIGHT name and logo are our trade marks.

Information is general only

Site content is general information about our practice, not professional, engineering, regulatory or legal advice, and should not be relied on. Advice is given only under a separate written engagement. Any case studies, capabilities or figures shown are illustrative and not a warranty or commitment as to results. Please take appropriate professional advice before acting on anything here.

Availability and liability

The Site is provided "as is" and "as available"; we do not guarantee it will be uninterrupted or error-free and may change or withdraw it without notice. So far as the law allows, we exclude implied terms and our liability for your use of, or reliance on, the Site, including any indirect or consequential loss or loss of profit, business, data or goodwill; and where liability cannot lawfully be excluded our total liability for the Site is limited to £100. Nothing in these Terms excludes any liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud. This applies to the Site only; liability for engagements is dealt with separately in our Terms and Conditions of Business (Design Services).

Other sites, privacy & changes

The Site may link to third-party sites and tools (including a scheduling tool to book a consultation); these are provided for convenience, are outside our control and have their own terms. How we handle personal data and cookies is set out in our Privacy & Cookies notice. We may revise these Terms by updating this page; continued use means you accept the change.

Governing law

These Terms, and any dispute or claim arising from them or your use of the Site, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
